Ms. Halliday, a felony who was on parole for heroin related crimes, was charged with giving a co-user friend of hers heroin. The friend overdosed and Ms. Halliday called 9-1-1 for assistance. She was ultimately charged with Aggravated Battery based upon a Heroin injection to her friend. The State did not offer her any resolution to the case. Her fact scenario did not fit the Good Samaritan defense. We tried the case and the jury acquitted her.
